Elope Easy uses this site to give a better service to its customers. Please read the following rules that govern your use of www.elope-easy.co.uk, which you accept by accessing it. If you don't agree, please don't use it. We reserve the right to update or change the Terms and Conditions at any time without prior notice, that is why we recommend that you read this section every time you use this site.

INTRODUCTION

The contract is in force from when you pay your booking fee with the intention of paying Elope Easy for planning and photographing your wedding. You are required to return the contract date and with both partners signatures. Failure to return the signed contract does not, however, invalidate the contract nor absolve you from the acceptance of the Terms & Conditions laid out in it.

1.AGREEMENT TO TERMS

By accessing or using this website, you agree to these terms and conditions. If you do not agree with any part of these terms, you should not use this website.

2. PRIVACY POLICY

Your use of our website is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.

Elope Easy adheres to the governing legislation with regard to protecting The Client's data. Elope Easy may store The Client's data in a secure private internal database. This data will not be made available to outside companies or individuals.

The Client's data will be stored securely for a minimum period of 7 years in case The Client's wish to re-order other products or use other services. After 7 years, The Client's data will be deleted, but The Client's images may still be archived.

In the event of a separation or divorce any online galleries, and at the request of BOTH parties, any online galleries will be removed and/ or deleted.  

Our team complies with data protection laws (like GDPR, General Data Protection Regulation) for handling personal data.

What This Means

I adhere to the governing legislation with regard to protecting your data. No one will get your data unless I’ve been hacked.

3. COPYRIGHT

The Copyright Designs and Patents Acts 1998 assigns the copyright of the images to Elope Easy (“we”, “us”, “our team”, or “our”). Elope Easy assigns limited rights to the client (“the Client”, “the “Client(s)”, “your”, or “you”) (subject to condition 5).

All content on this website, including text, images, graphics, and logos, is the property of Elope Easy and is protected by copyright laws.

The Client may reproduce, copy and distribute the photographs for personal use only. This is known as a “license to print.”

The Client is not authorised to copy and/or pass any photographs or derived products to any third party person and/or organisation for commercial use without first gaining permission in writing from the copyright owner (Elope Easy). This includes other vendors booked by the client for his or her wedding.

Elope Easy is happy to supply images to vendors / suppliers, but they must first seek permission.

What This Means

I own the copyright to the photographs and I give you a ‘personal license’ to use them or print them for personal use. You can not give them away to anybody else for commercial use without my permission. Simply ask your hairdresser, florist, venue, transport etc to get in touch with me for copies of the photographs. Otherwise, I will sue the people using them for commercial purposes.

4. DISPLAY AND USE FOR MARKETING PURPOSES

The Client hereby allows Elope Easy to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, social media, websites, sample albums and prints, venue and other vendor samples, and other such material, unless otherwise specified in a written agreement, and providing that the images used are used lawfully and without damage to The Client. 

Images may be used on social media to promote Elope Easy. Clients may be tagged in social media. Clients not wishing their images to be used must state this in writing at the time of booking.

What This Means

I have the right to use the images for marketing. If you don’t want your images online, in sample albums or in my brochures, that’s fine, just let me know in writing.

5. LICENSES, COVERAGE AND REPRODUCTION

a) Elope Easy shall be granted an artistic license in relation to the poses photographed and the locations used. Elope Easy judgment regarding the location, poses and number of photographs taken shall be deemed correct. Elope Easy will not be held liable for photographs that do not, for whatever reason, meet Elope Easy quality criteria and are not shown to The Client.

b) Photographs taken during the course of the event will be at the discretion of Elope Easy although every effort will be made to comply with The Client’s requirements.

c) Elope Easy shall endeavor to photograph all guests, if any, as requested by The Client at some point, but no responsibility or liability will be taken by Elope Easy on the occasion of leaving somebody out.

d) For a booking involving a church ceremony or at certain venues, our movements are sometimes restricted by the official in charge. The area from which we are able to cover the ceremony may not be our choice and we cannot accept responsibility or liability for any obstructed view should this be the case. The use of artificial lighting (flash) may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited.

e) For a wedding or other event booking, we shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.

f) Where The Client provides a list of photographs to be taken, it is incumbent upon the client to ensure the list is in an order that is logical and manageable. Clients are advised to discuss its feasibility with the photographer. Please, do keep in mind that each combination (family of the bridge only/ family of the groom only/ parents only…) takes about 2-3 minutes to be set up. We will follow the list “as is” without deviation. We may take additional photographs, as long as the list has been followed “as is” and completed. Clients are advised to think carefully about any photograph list.

g) Please note that any alterations made to the booking by The Client(s) once details have been confirmed may only be made at the discretion of Elope Easy and in some circumstances (such as the change of ceremony date for a wedding) Elope Easy may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances, Elope Easy are not liable to compensate the Client in any way whatsoever. We can suggest an alternative photographer/ planner, where possible.

h) Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Please note that certain colours do not reproduce exactly in print.

i) It is understood that all photographic printing is undertaken within the technical limitations of the process and that colours may not be identical over the whole range of colours within a subject. It is also understood that prints made at different times or in different sizes may be variable in colour balance.

j) Due to the limitations of computer monitors, it is understood that (1) images appear differently according to the specification of each monitor (2) prints might not match images rendered on any particular computer monitor.

k) Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, we will not be responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.

l) Where images are made available for use with a personal computer the default operating system shall be the latest Apple Mac OS X and Microsoft Windows operating systems. Products may not function on other or earlier operating systems.

What This Means

I can’t be held responsible for when you decide not to have family groups and then your parents complain about there not being family groups. Or, if someone isn’t present during a group photo. I also can’t be in two places at once, so if I miss a shot because I’m taking another shot, I apologise.

I’ll try and be logical with the list of photographs…but I do expect you to help me put it in logical running order!

I have backups, but even so if one of my cameras fail I may lose stuff. I use the latest Image Transfer Control gear, and colours are calibrated on my gear: if yours is older, it may not work, or the colours might not match. 

6. SERVICES

6.1 OVERVIEW

Elope Easy offers elopement facilitation and photography services through a range of packages. All services are designed to assist you in planning and capturing your special day, with a focus on flexibility and personal involvement. Below is a breakdown of the available service packages, including what's included and important limitations of responsibility.

Facilitator refers to guidance, research, and advisory support only. We do not act as legal or financial agents, make bookings, or submit payments on your behalf.

6.2 PACKAGES OUTLINE

a) Package 1- Photographer & facilitator, which includes personalised timelines, unlimited support, paperwork and rules guidance, location scouting, research on permits and experts, lists of vendors and celebrants, translation Italian/ English, full photographic coverage, high-resolution online gallery, complimentary album (when requested), and our travel, accommodation & food costs covered. If you choose the add-on option of package 2, the album can of course include your engagement photos as well. Package 1 is available in Scotland and Italy.

b) Package 2- Adventure engagement session, which includes 2-4 hour photography session (depending on chosen activities), session planning, unlimited consulting, location scouting, research on permits, photo shoot direction, translation Italian/ English (if in Italy), high-resolution online gallery, and our travel, accommodation & food costs covered.

Package 2 comes as (I) a standalone session (available in Scotland only), or (II) as an add-on to package 1 (scheduled the day before the elopement near the same location, for simplicity).

c) Package 3- Happily ever after: this 2–4 hour session is intended for couples already married who want new wedding photos in a natural outdoor location. Package 3 includes: 2-4 hour photography session (depending on chosen activities), session planning, unlimited consulting, location scouting, research on permits, photo shoot direction, translation Italian/ English (if in Italy), high-resolution online gallery, and our travel, accommodation & food costs covered. This package is available in Scotland only.

d) Package 4- Half-day photography only: this 2 hours session is intended for couple who need a photographer to cover the wedding essentials (ceremony + portraits). Package 4 is also intended for a honeymoon shoot or couple/solo/family portraits. This package includes: 2 hours photography service, high-resolution online gallery, and our travel, accommodation & food costs covered. This package is available in Scotland only.

6.3 SERVICES CLARIFICATIONS

a) Our team is available to offer each of these packages in other countries other than the ones outlined; prices may vary seasonally and depending on travelling distance.

b) Package 1 can be upgraded or downgraded at any time with the Package 2 add-on option. We recommend letting us know as soon as possible to be able to provide our services in full at the quality expected. Please refer to Section 13 for more details.

c) Package 1 includes a full-photographic coverage. Elope Easy will photograph your elopement day from your morning prep (at a time we agree with you beforehand) throughout the final activity of the day. Our team is used to long shooting days, and will endeavor to capture as much as possible, however we recommend the Client to be mindful of our team’s needs for breaks (including food and toilet breaks). Details in Section 16.

d) Package 2, 3 and 4 have a set duration, as specified above. Although there's no hard wrap time, longer shoots (5+ hours) may require an increase in price, to our discretion; we will always be transparent and discuss this with you before extending the shooting time.

6.4 SERVICES DESCRIPTIONS AND LIMITATIONS

a) Informal Translation and Interpretation Services- Elope Easy may provide informal translation or interpretation services to assist communication between the Client and Italian-speaking vendors or third parties. This may be in person, by phone, or in writing, and is offered to reduce the risk of misunderstandings. Please note:

  • We act solely as informal interpreters and do not hold official certification.

  • We are not liable for any errors, disputes, cancellations, unsatisfactory services, breach of contract, or damages resulting from third-party actions, services, or communication errors.

  • The Client is responsible for reviewing and agreeing to each vendor's Terms & Conditions.

b) List of Vendors, Celebrants and First Contact Support - as part of our facilitation services, we provide lists of recommended vendors, celebrants and locations; Initiate first contact or inquiries on your behalf (e.g. asking about pricing or availability); identify the appropriate party to contact (“expert”) to secure a venue, apply for a permit, or book a service. However:

  • We do not book, pay, or enter into agreements on your behalf.

  • We do not handle or transfer any funds between you and vendors.

  • You are solely responsible for confirming the legitimacy, availability, and suitability of any vendor or service.

  • Elope Easy assumes no liability for any third-party issue, cancellation, scam, breach of contract, personal injury, or property damage.

c) Location Scouting- we will always conduct research on the location and permits for your elopement, engagement, or happily ever after session. When appropriate (e.g., unfamiliar or remote areas), our team will perform a location scout to assess accessibility, terrain, travel times, and potential safety issues, and evaluate suitability for photography or ceremony logistics. Scouting will involve travel and is typically included in the cost of select packages. However:

  • We cannot guarantee exclusive access to or availability of public or unbookable locations.

  • We will advise to the best of our ability on any known safety risks, but assume no liability for injuries, accidents, or unforeseen conditions. See Sections 11 & 12 for further details on health and safety.

d)  Legal and Paperwork Guidance- we provide general support and non-legal guidance regarding marriage paperwork and processes, including answering questions about form fields and required documents, helping interpret Italian documents and government procedures, identifying appropriate contacts (e.g. registrars or local offices) for formal questions. While we do our best to stay up to date with legal requirements in Italy and Scotland:

  • Our guidance does not replace official legal advice or government consultation. This applies also to any guide published on www.elope-easy.co.uk.

  • We are not liable for incomplete, missing, incorrect, or late documentation.

  • You are responsible for confirming your legal requirements with the appropriate authorities, and for bringing your documents on your wedding day (unless otherwise stated by the registrar/ church minister).

e) Timeline Planning- As part of your planning process, Elope Easy will provide a suggested timeline for your elopement day, formatted at our discretion (e.g. Word document, Excel sheet, or stylized PDF with sample imagery). Please note:

  • The timeline is flexible and intended as a guide.

  • You may request edits to the schedule at any time.

  • However, once vendors, venues and activities are booked, third-party vendors may not accommodate changes without additional fees or restrictions — you must confirm directly with them. Elope Easy is not responsible for changes, cancellations, or delays resulting from third-party vendors.

  • Any additional activities requested spontaneously on the day of your event are subject to availability and not guaranteed. These are independent of Elope Easy and are not under our control or responsibility.

f) Communication and Support Access- we are committed to staying accessible throughout your planning process. While we describe our communication style as “unlimited,” this is subject to the following terms:

  • We respond to emails and messages Monday to Thursday, between 09:00 AM and 4:00 PM (BST).

  • You are welcome to call within these hours. For calls outside of these hours, please send a text or email to schedule a time.

  • We strive to respond as promptly as possible, but turnaround times may vary depending on workload.

  • We may respond out of working hours, but that is solely to our discretion and dependent on the urgency of the matter.

  • We understand some matters may require urgent actions: our team will do everything they can do support the Client in this sense.

g) Client Responsibility- you are responsible for:

  • Sending us the contact details of your chosen vendors, celebrants, or activity providers so we can coordinate with them on the day of the event, if needed.

  • Communicating directly with vendors to confirm bookings, policies, and terms.

  • Conducting your own research prior to making payments or commitments. Managing your own finances and agreements. Your money, your responsibility.

h) products (such as online galleries and albums)’ terms and conditions are outlined in sections 18,19,20,21,22, 23.

7. PRICES

a) All services and optional extras specified in this contract and paid for in full before the wedding are supplied at the prices ruling on the date of signing of the contract. Optional extras (such as, for example, packages add-ons or additional albums) not paid for in full before the wedding, are supplied at the prices ruling at the time of receipt of the order.

b) To book our services, the Client must provide accurate and complete information about their event & number of guests.

c) A deposit is required by the Client to secure the booking, with the remaining balance due on or before the event date.

d) The payment methods will be communicated during the booking process.

e) Travel expenses will always be specified in the contract summary, and covered by the booking fee.

f) In case of access fees charged by some venues, and dispatch of optional extras such as prints, discs, additional albums, and other products, the Client will be liable to pay any additional expenses incurred by Elope Easy not already included within the contract price.

What This Means

Price is fixed at the time of booking. If you order anything else, you have to pay for it.

8. PAYMENTS

a) A paid booking fee of 50% of the Client’s service of choice, along with a completed contract, will confirm your booking. The booking fee forms part of the total cost of your Package (i.e. it is NOT in addition to the cost of the plan) and is deducted when calculating the final balance due.

Once the Client has confirmed they want to work with us and the date, they have 5 days to pay the booking fee. In other words, the booking fee is payable within 5 working days from the date of booking. We will decline any other inquiries for the event date upon receiving this fee.

The Client will be sent one reminder to pay the booking fee, after this reminder the reservation will be automatically removed, and the date will become open for further bookings.

You have the right to cancel within 14 days after you have paid the booking fee. This will also cancel this contract and all future obligations between Elope Easy and The Client and the booking fee will be fully refunded within 5 working days, minus administration costs (sending invoices, contracts, merchant account fees, time etc).

b) For services that have an optional add-on, the total is calculated with the add on as well (for example, if a package costs £1000 and the Client asks for an optional add-on of £200, the 50% will be calculated on £1200, not £1000). If the add-on is added after the booking fee has been paid, its value will simply be added to the final balance yet to be paid (example, you secured your booking fee of £500, then you decide you want the add-on of £200: when it comes to pay the balance, you will give me £700 instead of £500). 

c) We will send out final invoices by email 6 weeks prior to your wedding date.

d) It is the client’s responsibility to ensure payment for any outstanding balance is paid in full NO LATER THAN FOUR WEEKS prior to the contracted date. For package 4 (see section 6), the outstanding balance has to be paid in full no later than two weeks prior the contracted date. For package 4, a deferred payment plan is not available. 

e) If you do not request a deferred payment plan, failure to pay four (4) weeks before the date of your wedding will be deemed a breach of contract and result in Elope Easy not attending your wedding.

f) Please note that there is the option to request 1 complimentary album, either digital or printed. Please, note that if you do wish to receive your complimentary album, you are advised to do so as soon as possible, as after 6 months, we cannot guarantee the digital files will still be available.

g) All additional invoices resulting from additions ordered by the Client must be paid for in full on ordering. This includes extra shooting day and related travel expenses, add-ons, extra services, extra albums, or products, special editing and rendering of images, high-resolution long-term galleries, and any other services ordered after the event. Title to all goods, including but not limited to prints, wedding albums and other products/additional extras remains with Elope Easy until paid for in full by The Client(s). Until then, access to the wedding gallery won’t be granted.

h) A deferred payment option is available if required. Under this option you may choose to defer payment of the balance until a maximum of three months after the wedding date, or to pay the balance in three installments. Please, communicate this at the time of booking.

i) If the balance if not paid on time, then you agree to a service charge based on the prevailing Bank of England “base rate” at the time of the invoice for every month the balance is not paid.

The service charge will be simple interest only and not compounded.

This service charge covers the extra administration in sending out reminders and the financial loss Elope Easy may incur as a result of the invoice not being paid.

What This Means

I expect to be paid, and paid on time. You have the right to cancel within 14 days but will be charged for my time, administration costs (sending invoices, contracts, merchant account fees etc) and this will be deducted from the booking fee.

Once you have confirmed you want to work with me and the date, you have 5 days to pay the booking fee or I’ll take the next wedding on that date. I’ll send final invoices 6 weeks before your wedding to give you plenty of time to pay. You have to pay the final invoice 4 weeks before your wedding, (or 2 for package number 4); if not I may deem this a breach of contract and not turn up.

No finished products will be sent to you until the final deferred payment is made.

If you take the deferred payment, you agree to the service charge, based on the Bank of England’s base rate prevailing at the time for every month the invoice is late.

Please note – Until you pay the final balance, you won’t have access to the gallery.

9. COMPLAINTS

Any complaints must be received in writing within seven (7) days of receipt of services provided or products purchased (including digital products).

Where the complaint is about a product then a period of 14 days is required for inspection of the product. The Client must return the product to us, in the packaging it was sent in. The Client has to pay the return postage.

What This Means

You have the right to complain and the right for that complaint to be resolved.

10. LIABILITY FOR DIGITAL FILES AND PRODUCTS

a) The digital files shall remain the property of Elope Easy and shall be kept by them for not less than 6 months from the wedding date at one site.  



b) Should digital files be lost, damaged or destroyed, our liability shall be limited to a refund of fees paid, but shall not include a refund for any goods already supplied or capable of supply at a quality deemed acceptable by us. No refund will be due for any digital files lost, damaged, or destroyed after 6 months from the date of the wedding. 



c) Please download your photographs and store them safely and securely. After 6 months we cannot guarantee they will still be available. Download your wedding photographs as soon as you get them. 

d) All digital unedited (known as RAW) files will be deleted 3 months after the date of the wedding. If you require copies of these files you may purchase them at the prevailing price indicated in Section 26.

e) Please, note that you do wish to receive your complimentary album, you are advised to do so as soon as possible, as after 6 months, we cannot guarantee the digital files will still be available. If requested, the album, as well as any additional extra ordered, will be sent by standard Royal Mail to the last known address of the clients. Please, make sure you provide the correct address! Additional reproduction, administration and postage charges of £100 will apply if you do not inform Elope Easy of your change of address, or you lose your copy of your wedding photographs. 

What This Means

Shit happens. This covers me in case of that happening! If shit happens to you and you lose your wedding photographs then there is an admin fee of £100 for me to upload them again, assuming that I have a working copy.

11. HEALTH AND SAFETY

a) Elope Easy is committed to conducting all services with professionalism and regard for safety. However, by engaging our services, the Client and their guests acknowledge and accept that elopement photography and the associated activities may involve travel to remote or natural environments and/or participation in potentially hazardous activities (including but not limited to hiking, skiing, snowboarding, or similar). The Client and their guests understand and agree that participation in such activities is entirely voluntary and at their own risk.

b) We may suggest suitable and reasonable setups for photographs to The Clients and it is assumed The Client accepts liability, except for injury or death, for those photographs should The Client agree to our request.

c) Elope Easy is not responsible for the actions, safety, conduct, or well being of the Client, their guests, or any third parties at any time during the planning or execution of the elopement event. Elope Easy does not book or pay for venues, permits and vendors, limiting its services to researching information regarding them — all such arrangements are the sole responsibility of the Client. The final decision regarding location and activities always rests with the Client.

d) While we take reasonable steps to mitigate risks within our control, Elope Easy accepts no liability for personal injury, loss, accident, or damage to property, howsoever caused, whether before, during, or after the elopement. It is the client’s responsibility to take care of and look after their own personal effects and belongings. The Photographer/s does not accept liability for items left with The Photographer/s for any reason. Any items left with The Photographer/s are left entirely at your own risk. The Photographer does not accept any consequential loss for items left with the Photographer. Clients are advised to carry their own travel and activity insurance to cover such events.

e) Elope Easy reserves the right to suspend or terminate services immediately, without liability, in circumstances where we reasonably believe our team’s safety is at risk, including threatening or abusive behaviour or equipment wreckage by the Client, guests, or any third party. Where we feel unsafe, personally uncomfortable or assess the risk to be unacceptable, we will inform the client and give reasonable time for the issues to be resolved. If the issues are not resolved, we reserve the right to leave immediately without further notice.

f) The Client will advise any other venues that they are responsible for our team’s health & safety and our team will take all reasonable and sensible precautions whilst on the premises of other suppliers/venues etc.

What This Means

I’m a nice person, and will take your bags/personal belongings to the wedding venue to save space in cars etc. I will make sure I take as much care and attention as my job allows. I will always keep health and safety in mind when suggesting setups. However, I’m not accepting liability, responsibility or accountability for those in any way, shape or form.

12. FORCE MAJEURE

a) The due performance of the contract is subject to alteration or cancellation by Elope Easy owing to any cause beyond their reasonable control including, but not limited to, Natural disasters (e.g. floods, landslides, wildfires), epidemic, pandemic, Advice or directives from emergency services, government, or local authorities (including but not limited to measures such as ‘lockdown’, ‘social distancing’) prevailing weather conditions, sudden illness/injury/victim of crime, etc. With specific regards to weather conditions, we will make all reasonable and safe attempts to attend your wedding; however, we will take the advice of Police and Emergency Services into consideration. We will provide as much notice as reasonably possible in this event.

b) Elope Easy will attempt to accommodate reasonable date changes for The Client under Section 12a above and Clients are advised to liaise with us in the first instance should they require a date change by phoning or emailing us directly. 

c) We may contact other photographers in the event that they are not able to attend your booking due to clause 12a. However, it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.

d) In the event of cancellation by Elope Easy within 3 months, or in the unlikely event of failure to provide the services and products requested as detailed in section 12a and 12b, or in the unlikely event of total photographic failure (although re-shoots may be arranged if practicable), Elope Easy’s liability shall be limited to a full refund of any deposits, booking fees and other fees paid not withstanding Section 13 -we will not be responsible for costs in order to stage re-shoots.

What This Means

Shit happens. This covers me in case of that happening.  I don’t mind a bit of rain, but in case of a serious weather warning I might deem the conditions to work unsafe (and I don’t think you’d want to risk getting married during a thunderstorm either). If I get diagnosed with a terminal illness I’d prefer to spend my time with family!

13. CANCELLATION FEES, DATE AND PACKAGE CHANGES

The Client(s) have the option to cancel within 14 days from the date of booking, even if the booking fee has been paid. After that 14 days no refunds will be given.

a) Should The Client(s) have to cancel a booking after the 14 days from booking, the booking fee cannot be refunded, and the following reasonable cancellation charges will apply, notwithstanding Section 12:

  • Less than 28 working days prior to the wedding date stated– 65% of balance outstanding.

  • 29 – 84 working days prior to the wedding date stated – 35% of balance outstanding.

  • 85+ working days prior to the wedding date stated – 0% of balance

Please note that the booking fee is to cover the Fixed Costs for Elope Easy in gaining the booking and the reasonable cancellation fees are to cover the loss of profit resulting from the cancellation.

All notice to cancel must be given as soon as possible; a telephone call is acceptable to inform our team as soon as possible; however, this needs to be confirmed in writing via e-mail.

A working day is defined as Monday – Thursday.

b) The Client may change the date booked earlier, if it is not booked it already. Additional charges may apply at the sole discretion of Elope Easy, for example to cover for accommodation or flight changes, and written consent is required.

c) The Client may upgrade or downgrade package 1 at any time. The add-on amount will be added to the same invoice as the due balance, and the updated total expected to be paid no later than four weeks before the wedding day. No additional charges apply, and written consent is required. Should the Client wish to downgrade package 1 + package 2 to package 1 only, the add-on price of package 2 will be deducted from the due balance. Failure in communicating your desire of upgrading or downgrading your package may result in the originally agreed package being delivered as planned, with no entitlement to a refund, price adjustment, or rescheduling.

What This Means

I run a business and have a mortgage to pay. If you cancel within the sliding scale you will be sent an invoice and you will be taken to the Small Claims Court for that money if that invoice is not paid.

14. GOVERNING LAW

a) Any contract made between Elope Easy and The Client shall in all respects be governed by and construed in accordance with UK law and the parties hereto submit to the jurisdiction of the Scottish courts. 

b) You agree to the Terms & Conditions of this contract once your booking fee has been paid.

c) There is no legal requirement for you to sign and return this contract once the booking fee has been paid.

d) In case of working in an abroad (not UK) destination, our team will adhere to the local laws of that country. Should any dispute arise whilst working in an abroad (not UK) destination, they will be resolved under the UK law.

e) Our team will comply with data protection laws (like GDPR, General Data Protection Regulation) for handling personal data.

15. INSURANCE

The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation or other situations arising.

What This Means

Get. Wedding. Insurance. I will have to make a claim against your insurance, should a situation arise.

16. MEALS, REFRESHMENTS and BREAKS

Our team is used to long shooting days, and will endeavor to capture as much as possible, however we recommend the Client to be mindful of our team’s needs for breaks (including food and toilet breaks).

a) All packages offered by Elope Easy account for meal expenses of our team. 

b) Our team will take a break from working whilst eating their food. Break length will be sensible and in accordance with the day’s timeline, to ensure no key moments are lost. This may include them going somewhere else to buy their own food or take some time off and recharge. Our team will always be reachable over the phone and won’t leave for long. 

What This Means

There are no hidden fees in regards with meals and refreshments- however, I do appreciate when the couple offers me to sit at their table instead of my packed lunch. Breaks- they are really important to recharge and get ready to keep up the excellent work. And I am sure you will love a moments free from cameras as well. 

17. ON THE DAY

a) Elope Easy is the only authorised photographer for the day. Other professional photographers are not permitted whether official or otherwise, working for pay or otherwise (e.g. separately employed by parents, contracted by magazines or newspapers), unless agreed in writing before the day. Breach of this condition shall be deemed cancellation of the contract by the Clients. 

Please, be aware that, if any guest or vendor get in the way while we are taking photographs, in such a way that our job is constrained and we can’t properly perform my service to you, we will not digitally remove them free of charge.

b) Elope Easy is contracted to shoot all photographs relating to the event and no other person is permitted to shoot images for sale or as gifts unless agreed in writing before the day. This includes guests (except for their own personal non-commercial use) and other wedding vendors e.g. a videographer may not shoot stills other than a small quantity to illustrate the video packaging. Breach of this condition shall be deemed cancellation of the contract by the clients.

c) An inconsiderate guest or other supplier can wreck the photographic record of your special day. Coverage may be cancelled without warning at the discretion of Elope Easy if our team feels threatened in any way, shape, or form or has reason to believe that equipment may be damaged or stolen. Please refer to Section 11 for more details. 

What This Means

I’m the ONLY official wedding photographer. If you have a guest who wants to help please run it by me first – I’m generally ok with it as long as I know beforehand.

Guests who interfere with my job may mean that I miss photographic opportunities. I can’t be held responsible for that.

18. ONLINE GALLERY

a) The online gallery will be available from 4 working weeks after the wedding date (please note this is an estimate- see section 22 for more details).

b) The gallery will contain all high-resolution edited images that Elope Easy as deemed to be at an acceptable enough quality. If you have communicated, at the time of booking, that you do not wish for your images to be displayed on my website, as outlined in Section 4, the gallery will be password protected and visible only to you.

c) In any circumstance you will be the only one able to download the images and retain printing rights as per Section 3.

d) You are advised to download all your images as soon as possible, as after 6 months, I cannot guarantee the digital images will still be available.

19. ALBUM DEADLINES

a) If you want your complimentary digital or printed album, you have 6 months from the date of your wedding photographs being online to choose your favourite wedding photographs for your wedding album and send those to elope.easy@outlook.com. It is your responsibility to send us your favourite wedding photographs for your wedding album.

b) If possible, let us know at the time of booking that you desire a wedding album, and in what format (digital or printed). From when you send us your favourite photos, allow 14 days for the album drafts (section 22 outlines delivery time frames).

c) Postage of additional albums, where the delivery address is more than 25 miles (50 miles round trip) from Doune, will incur a fixed charge of £20 to be paid before the album is sent. Albums will be packaged safely and posted via Royal Mail at Second Class.

Photographs of proof of packaging and the Royal Mail reference number will be kept in case of disputes.

What This Means

It’s your wedding album. If you want it, choose the photographs and send them to me pronto. After 6 months, I cannot guarantee I will still have the digital copies of the photographs.

For extra albums, it costs me to post them: therefore, a fixed charge of £20 in addition to paying for the extra album is required.

20. ALBUM DESIGN

a) Every effort will be made to accommodate specific requests for album design and layout by the client/s however the final artistic decision lies with our team. 

b) 20 changes can be made to the initial wedding album design at no cost. A change is defined as adding, replacing, moving or converting to Black and White version, or vice versa, a wedding photograph. Thereafter a charge of £10 per requested change to the wedding album will be accrued by the client/s.

c) Where The Client requests an on-site visit to finalise the album, sort out changes, etc, then a flat fee of £125 will be charged.

The album will not be sent to print unless any outstanding balance from the changes has been settled and the Album Print Sign-Off form has been returned and confirmation email sent out by our team. 

What This Means

I’ll check to make sure your album is correct in every detail. You also have a responsibility to check it before sending to print. Mistakes that are my fault will be rectified at no cost. Mistakes that are your fault will be charged.

21. PLACING AN ORDER AND RECEIPT OF GOODS

a) Any alterations to orders must be notified either by phone or email, and confirmation received. Elope Easy will not be held liable for any costs incurred due to alterations to the order made by The Client after this time.

b) Our team must be notified either by telephone or email and confirmed in writing (sent by Royal Mail special delivery) within three working days of the client(s) being in receipt of their order in the case of error, shortage or damage, as mistakes cannot be rectified after this period.

c) All wedding albums will be required to be signed off via email before being sent to print. It is The Client’s responsibility to sign off of the album via email. Elope Easy won’t send out the album until it has been signed off by The Client. The Client will then receive a confirmation email, and the delivery process will begin. 

d) Allow 4 weeks for delivery of the album from the confirmation email.

e) Due to the personal nature of the products, the photographer(s) are unable to give exchanges or refunds unless mistakes were made by either our team or printing company.

This does not affect your statutory rights.

What This Means

If you want to make changes you MUST make sure you let me know. As albums and prints are personal products they will not be refunded or exchanged if they are wrong and it’s your fault.

22. DELIVERY TIME FRAMES

Due to workload at particular times of the year the dates below are estimates only.

Online gallery of wedding photographs: 28 days
Album draft: 14 days from receiving your wedding photograph choices
Wedding album changes: 2 weeks per round of changes
Printed Wedding Albums: 4 weeks after sign off from yourselves. Please, refer to section 20 for more details.

During summer wedding season, please allow 5 days extra for busy periods, although we will attempt to meet the 4 weeks maximum for delivery of your wedding photographs.

What This Means

I am working as hard as I can to edit your photos/ prep your albums.  Please, don’t nag me. You’ll go to the back of the queue.

23. IMAGE MANIPULATION

a) Our team will apply a range of standard image manipulation techniques to the Client wedding photographs.  This includes, but is not limited to skin smoothing, sharpening and Black & White conversions.

b) The Client shall not be charged for removing features that are not normally present. This includes but is not limited to items such as stress spots, cold sores and shaving/heat rashes. This does not include reactions to makeup or medication however.

c) Image manipulation for reasons of “digital cosmetic surgery” will be charged a rate of £125 per hour or part thereof. This includes but is not limited to tattoo removal, tan line removal, enhancements or reductions to the natural figure. It is estimated that 4 photographs can be edited per hour.

d) Wherever possible, the photographer will attempt to avoid distractions in the background whilst shooting and editing; however, the nature of weddings and wedding photography makes it hard to achieve this 100%. Where this is not possible, a flat charge of £125 per wedding gallery may be applied if you request to remove these distractions.

e) The photographer reserves the right to refuse requests for any photo manipulation where, in the opinion of the photographer, the requests are excessive.

What This Means

For example, if your makeup artist isn’t good enough and your makeup comes bad, or you have an adverse reaction to medication (including skin creams of any kind) I will charge you for editing any images.

24. USE OF DRONES  BY OTHER WEDDING SUPPLIERS

Elope Easy will not be held liable or accountable for any issues and/or accidents involving the use of drone technology by other wedding suppliers or guests.

It is your responsibility to ensure that other suppliers (videographers etc) are fully licensed and insured to use drone cameras and or drone video equipment. It is a criminal offence to use a drone for paid or commercial work without valid CAA permission and commercial insurance.

What This Means

You need a license to use a drone commercially. If your videographer doesn’t have one I won’t work with them; it’s not legal. If your videographer has an accident with a drone, I will make sure it’s clear it wasn’t my fault. 

25. SUITABLE CLOTHING & PREPPING

a) Please wear appropriate clothing for your bridal preparation photographs. Consideration should be given as to who you will get into your wedding dress to avoid damaging hair/makeup. This also applies to bridesmaids’ clothing during bridal prep. This will help your make-up artist (MUA) and hairdresser ensure their work doesn’t get damaged from tight-fitting clothing having to be taken over your head and to ensure that strap marks (from underwear) are not visible during your wedding photographs.

b) If hiking or undertaking any other activity before, during or after your ceremony, please consider wearing appropriate footwear and clothing, to be swapped with wedding attire when necessary and where safe. Our team will bring a changing pop-up tent to give you privacy, should you require to get changed in the wild.

c) Elopements involve getting married in outdoor and sometimes remote locations. Please consider temperatures and weather when deciding what to pack, and consider bringing a rucksack with the essentials if you decide to get changed on location. The Client and their guests understand and agree that participation in outdoor activities is entirely voluntary and at their own risk. Please refer to Section 11 and 12.

d) It is advised to wear loose fitting garments that easily be unbuttoned or easily removed over your head and shoulders.

e) The removal of strap marks is not included in our standard editing and retouching of your wedding photographs would incur an extra charge (as per Section 24).

f) As part of Elope Easy’s services, the photographer is happy to help fixing hair, dress and accessories during the session.

26. AMENDMENTS TO THIS CONTRACT

Any error or omission in any information or document we issue shall be subject to correction provided that the correction does not materially or financially affect the contract.

What This Means

I may make amendments to the contract at times.  They won’t impact your financially if you/me abide by the TCs when you booked.
