I adhere to the governing legislation with regard to protecting your data. No one will get your data unless I’ve been hacked.
3. COPYRIGHT
The Copyright Designs and Patents Acts 1998 assigns the copyright of the images to Elope Easy (“we”, “us”, “our team”, or “our”). Elope Easy assigns limited rights to the client (“the Client”, “the “Client(s)”, “your”, or “you”) (subject to condition 5).
All content on this website, including text, images, graphics, and logos, is the property of Elope Easy and is protected by copyright laws.
The Client may reproduce, copy and distribute photographs for personal use only. This is known as a “license to print.”
The Client is not authorised to copy and/or pass any photographs or derived products to any third-party person and/or organisation for commercial use without first gaining permission in writing from the copyright owner (Elope Easy). This includes other vendors booked by the client for his or her wedding.
Elope Easy is happy to supply images to vendors / suppliers, but they must first seek permission.
4. DISPLAY AND USE FOR MARKETING PURPOSES
The Client hereby allows Elope Easy to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, social media, websites, sample albums and prints, venue and other vendor samples, and other such material, unless otherwise specified in a written agreement, and providing that the images used are used lawfully and without damage to The Client.
Images may be used on social media to promote Elope Easy. Clients may be tagged on social media. Clients not wishing their images to be used must state this, in writing, if possible, at the time of booking.
What This Means
I have the right to use images for marketing. If you don’t want your images online, in sample albums or in my brochures, that’s fine, just let me know in writing.
5. LICENSES, COVERAGE AND REPRODUCTION
a) Artistic License
Elope Easy shall be granted an artistic license in relation to the poses photographed and the locations used. Elope Easy judgment regarding the location, poses, and number of photographs taken shall be deemed correct. Elope Easy will not be held liable for photographs that do not, for whatever reason, meet Elope Easy quality criteria and are not shown to The Client.
b) Photographer’s Discretion
Photographs taken during the event will be at the discretion of Elope Easy, although every effort will be made to comply with The Client’s requirements.
c) Guest Coverage
Elope Easy shall endeavor to photograph all guests, if any, as requested by The Client at some point, but no responsibility or liability will be taken by Elope Easy when leaving somebody out.
d) Venue and Religious Restrictions
For a booking involving a religious site (church or similar) or at certain venues, our movements are sometimes restricted by the official in charge. The area from which we are able to cover the ceremony may not be our choice, and we cannot accept responsibility or liability for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all the ceremony may be restricted or prohibited.
e) Event Coverage
For a wedding or other event booking, we shall endeavor to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded or not recorded for logistical reasons.
f) Client’s Photograph List
Where the Client provides a list of photographs to be taken, it is incumbent upon The Client to ensure the list is in an order that is logical and manageable. Clients are advised to discuss its feasibility with the photographer. Please note that each combination (family of the bride only, family of the groom only, parents only, etc.) takes about 2–3 minutes to be set up. We will follow the list “as is” without deviation. We may take additional photographs once the list has been completed. Clients are advised to think carefully about any photograph list.
g) Alterations by The Client
1.Any alterations made to the booking by The Client once details have been confirmed may only be made at the discretion of Elope Easy. In some circumstances (such as the change of ceremony date for a wedding) Elope Easy may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances, Elope Easy is not liable to compensate The Client. We can suggest an alternative photographer or planner where possible.
2.In relation to vendors booked through us: Elope Easy arranges services with third-party vendors on behalf of the Client. The Client shall contract with and pay third-party vendors directly, and the Contractor shall not receive, hold, or transfer funds on behalf of the Client or any vendor, nor shall the Contractor receive any commission in connection with such arrangements.
Should a vendor be unable to accommodate alterations or cancel, we will make reasonable efforts to assist The Client in sourcing a replacement, but we are not liable for any failure, breach, or non-performance by the vendor. Our liability is limited to the planning and coordination services we provide directly, and to the extent covered by our Superscript professional indemnity and public liability insurance.
h) Colour Variation in Photography
Due to a variety of lighting conditions and limitations of digital sensors, some colours may alter throughout a set of photographs. Certain colours may not reproduce exactly in print.
i) Printing Limitations
It is understood that all photographic printing is undertaken within the technical limitations of the process and that colours may not be identical over the whole range of colours within a subject. Prints made at different times or in different sizes may be variable in colour balance.
j) Computer Monitor Limitations
Due to the limitations of computer monitors, it is understood that: (1) images appear differently according to the specification of each monitor and (2) prints might not match images rendered on any particular computer monitor.
k) Equipment Failure
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, Elope Easy will not be responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.
l) Technical Compatibility
Where images are made available for use with a personal computer, the default operating system shall be the latest Apple Mac OS X and Microsoft Windows operating systems. Products may not function on other or earlier operating systems.
6. SERVICES
Elope Easy offers elopement planning and photography services through a range of packages. Please refer to your contract for clarifications, details, and limitations of your chosen package.
Our website and services cannot replace or substitute for the expertise of trained professionals in fields such as financial, medical, psychological, therapeutic, or legal matters.
Services are delivered with reasonable care and skill in line with UK consumer law. Any request falling outside the agreed package may incur additional charges. Booking fees are non-refundable after 7 days, and secure for your date: remaining payments must be made according to the agreed schedule. Failure to pay may result in suspension of services until settlement.
The Client is responsible for providing accurate and timely information, confirming all vendor terms directly, and ensuring all legal and logistical requirements are met.
This includes answering the Contractor’s emails or phone calls, informing the Contractor timely shouldn’t they be able to join a scheduled meeting, and be proactive in the decisional process.
Failure to do so may result in the Contractor’s inability to provide the agreed service to the quality standards expected, and the Contractor cannot be held liable for the Client’s absence of engagement.
Repeated missed appointments and absence of engagement may result in a cancellation of the Agreement at the Contractor’s discretion, and all the cancellation charges will apply, as outlined in Section 13.
Vendors are not subcontractors of Elope Easy, and the underlying contract remains between the Client and the vendor. Elope Easy cannot be held liable for delays, errors, or issues caused by third-party vendors or the Client’s own actions.
In the event of cancellation, fees already paid (excluding deposits) may be refunded at our discretion, depending on notice given and work already completed. In the case of postponement, we will make reasonable efforts to transfer services to the new date, subject to availability and potential additional costs.
Insurance: Elope Easy holds professional indemnity, equipment, and public liability insurance through Superscript, covering both planning and photography services. This insurance protects our business against certain risks if we are negligent, but it does not cover or make us liable for a vendor’s breach of contract, cancellation, or non-performance. Clients remain responsible for securing their own event or wedding insurance to cover risks such as vendor failure, cancellations, or unforeseen circumstances.
7. PRICES
a) All services and optional extras specified in this contract and paid for in full before the wedding are supplied at the prices ruling on the date of signing of the contract. Optional extras (such as, for example, package add-ons) not paid for in full before the wedding are supplied at the prices ruling at the time of receipt of the order.
b) To book our services, the Client must provide accurate and complete information about their event and number of guests.
c) Except as otherwise provided in the Agreement, all monetary amounts referred to in the Agreement are in GBP.
d) In the case of access fees charged by some venues, and provision of optional extras, the Client will be liable to pay any additional expenses incurred by Elope Easy that are not already included within the contract price. Where such expenses relate to vendors, the Client remains directly responsible for the vendor’s terms.
8. PAYMENTS
Once the Client has confirmed they want to work with us and the date, they have 5 days to pay the booking fee. In other words, the booking fee is payable within 5 working days from the date of booking. We will decline any other enquiries for the event date upon receiving this fee.
The Client will be sent one reminder to pay the booking fee. After this reminder, the reservation will be automatically removed, and the date will become open for further bookings.
To book the Contractor’ services, the Client must provide accurate and complete information about their event and number of guests.
You have the right to cancel within 7 days after you have paid the booking fee. This will also cancel this contract and all future obligations between Elope Easy and the Client, and the booking fee will be fully refunded within 5 working days, minus administration costs (sending invoices, contracts, merchant account fees, time invested, etc).
For the remaining amount (the “Balance”), Elope Easy will invoice the Client 6 weeks prior the wedding date, with outstanding balance to be paid no later than 4 weeks prior the wedding date.
The payment methods will be communicated during the booking process.
Travel and accommodation expenses will always be specified in the contract summary and calculated in the balance invoice, when present. Travel expenses are applied for any trip over 2 hours' drive from FK16.
The Booking Fee above mentioned covers only Elope Easy services. Any funds required to confirm vendors must also be paid by the Client directly to the vendor, according to the vendors’ timeframe.
Likewise, the rules mentioned above regarding the Balance apply only to the Contractor’s services, and any vendor balance should be cleared in the modalities and timeframes indicated by the vendors at the time of booking. The Contractor may help the Client have a clear understanding of who to pay when, by providing a timeline of payments due, if requested.
b) The Client may upgrade or downgrade any package at any time. The add-on amount will be added to the same invoice as the due balance, and the updated total must be paid no later than FOUR weeks before the wedding day. No additional charges apply, and written consent is required.
Should the Client wish to downgrade, the difference will be deducted from the due balance.
Failure to communicate an upgrade or downgrade request may result in the originally agreed package being delivered as planned, with no entitlement to a refund, price adjustment, or rescheduling. Please note, where a package change affects vendor services, vendor availability and cancellation terms will apply separately.
c) We will send out final invoices by email 6 weeks prior to your wedding date.
d) It is the Client’s responsibility to ensure payment for any outstanding balance is paid in full no later than 4 weeks prior to the contracted date. For Package 4 (see section 6), the outstanding balance has to be paid in full no later than 2 weeks prior to the contracted date. For Package 4, a deferred payment plan is not available.
e) If you do not request a deferred payment plan, failure to pay 4 weeks before the date of your wedding will be deemed a breach of contract and result in Elope Easy not attending your wedding.
f) All additional invoices resulting from additions ordered by the Client must be paid for in full on ordering. This includes extra shooting days and related travel expenses, add-ons, extra services, special editing and rendering of images, high-resolution long-term galleries, and any other services ordered after the event. Title to all goods remains with Elope Easy until paid for in full by the Client. Until then, access to the wedding gallery will not be granted.
g) A deferred payment option is available if required. Under this option you may choose to defer payment of the balance until a maximum of three months after the wedding date, or to pay the balance in three instalments. Please, communicate this at the time of booking.
h) Interest payable on any overdue amounts is charged at an annual rate of 15%, calculated on a simple interest basis (not compounded). The charge will accrue monthly at 1.25% of the outstanding balance until paid in full.
This service charge covers the extra administration in sending out reminders and the financial loss Elope Easy may incur as a result of the invoice not being paid.
9. COMPLAINTS
Any complaints must be received in writing within seven (7) days of receipt of services provided or products purchased (including digital products).
Where the complaint is about a product then a period of 14 days is required for inspection of the product. The Client must return the product to us, in the packaging it was sent in. The Client has to pay the return postage.
10. LIABILITY FOR DIGITAL FILES
a) The digital files shall remain the property of Elope Easy and shall be kept for no less than 6 months from the wedding date at one site.
b) Should digital files be lost, damaged or destroyed, our liability shall be limited to a refund of fees paid for our services, but shall not include a refund for any goods already supplied or capable of supply at a quality deemed acceptable by us. No refund will be due for any digital files lost, damaged, or destroyed after 6 months from the date of the wedding.
This limitation applies only to services directly provided by Elope Easy. It does not extend to vendor services, for which the Client contracts directly.
c) Please download your photographs and store them safely and securely. After 6 months we cannot guarantee they will still be available. You are strongly advised to download your wedding photographs as soon as you receive them.
d) All digital unedited (known as RAW) files will be deleted 3 months after the date of the wedding. If you require copies of these files you may purchase them at the prevailing price indicated in Section 26.
11. HEALTH AND SAFETY
a) Elope Easy is committed to conducting all services with professionalism and regard for safety. However, by engaging our services, the Client and their guests acknowledge and accept that elopement photography and the associated activities may involve travel to remote or natural environments and/or participation in potentially hazardous activities (including but not limited to hiking, skiing, snowboarding, or similar). The Client and their guests understand and agree that participation in such activities is entirely voluntary and at their own risk.
b) We may suggest suitable and reasonable setups for photographs to the Client, and it is assumed the Client accepts liability, except in cases of injury or death, for those photographs should the Client agree to our request.
c) Elope Easy is not responsible for the actions, safety, conduct, or wellbeing of the Client, their guests, or any third parties at any time during the planning or execution of the elopement or engagement event. The final decision regarding location and activities always rests with the Client.
d) While we take reasonable steps to mitigate risks within our control, Elope Easy accepts no liability for personal injury, loss, accident, or damage to property, however caused, whether before, during, or after the elopement. It is the Client’s responsibility to take care of and look after their own personal effects and belongings. The Photographer does not accept liability for items left with them for any reason. Any items left with the Photographer are left entirely at the Client’s own risk. The Photographer does not accept any consequential loss for items left in their care. Clients are advised to carry their own travel and activity insurance to cover such events.
e) Elope Easy reserves the right to suspend or terminate services immediately, without liability, in circumstances where we reasonably believe our team’s safety is at risk. This includes threatening or abusive behaviour or equipment damage by the Client, guests, or any third party. Where we feel unsafe, personally uncomfortable, or assess the risk to be unacceptable, we will inform the Client and give reasonable time for the issues to be resolved. If the issues are not resolved, we reserve the right to leave immediately without further notice.
f) The Client will advise any other venues that they are responsible for our team’s health and safety. Our team will take all reasonable and sensible precautions whilst on the premises of other suppliers, venues, or locations.
12. FORCE MAJEURE
a) The due performance of the contract is subject to alteration or cancellation by Elope Easy owing to any cause beyond our reasonable control including, but not limited to, natural disasters (e.g. floods, landslides, wildfires), epidemic, pandemic, advice or directives from emergency services, government, or local authorities (including but not limited to measures such as ‘lockdown’, ‘social distancing’), prevailing weather conditions, sudden illness/injury/victim of crime, or other force majeure events.
With specific regards to weather conditions, the Contractor will make all reasonable and safe attempts to attend your wedding, as well as planning a sheltered location B, wherever possible. However, the Contractor will take the advice of Police and Emergency Services into consideration. The Contractor will provide as much notice as reasonably possible in such an event.
b) Elope Easy will attempt to accommodate reasonable date changes for the Client under Section 12a above, and Clients are advised to liaise with us in the first instance should they require a date change by phoning or emailing us directly.
c) We may contact other photographers or planning assistants in the unlikely event that we are not able to attend your booking due to clause 12a. However, it may prove difficult or impossible to find a skilled replacement at short notice or at the same price.
13. CANCELLATION FEES, DATE AND PACKAGE CHANGES
a) The Client has the option to cancel within 7 days from the date of booking, even if the booking fee has been paid. This will also cancel this contract and all future obligations between the Contractor and the Client, and the booking fee will be fully refunded within 5 working days, minus administration costs (sending invoices, contracts, merchant account fees, time invested, etc).
Should the Client cancel a booking after the 7-day period, the booking fee cannot be refunded. In addition, the following reasonable cancellation charges will apply, notwithstanding section 12. Should the Client fail to engage in the planning process (see Services Outline/7), the Agreement may be terminated at the Contractor’s discretion, and the following reasonable cancellation charges will apply:
Less than 28 working days prior to the wedding date stated: 65% of balance outstanding.
29–84 working days prior to the wedding date stated: 35% of balance outstanding.
85+ working days prior to the wedding date stated: 0% of balance outstanding.
The booking fee represents the fixed costs for Elope Easy in securing the booking. The cancellation charges are a genuine pre-estimate of the loss of profit and administration costs that result from cancellation.
If the Client cancels, any vendor cancellation policies and charges also apply, and these are the responsibility of the Client. Elope Easy is not liable for vendor fees or losses resulting from Client cancellation.
All notice to cancel must be given as soon as possible. A telephone call is acceptable to inform our team urgently; however, this must always be confirmed in writing via email.
Mobile Number: 0044 7546 970528
A working week is defined as Monday to Friday.
b) The Client may change the date booked earlier, provided that the new date is not already reserved. Additional charges may apply at the sole discretion of Elope Easy, for example to cover accommodation or flight changes. Any such change requires written consent. Please note: where vendors are already booked, their own availability and rescheduling terms will apply. Elope Easy acts only as a coordinator in securing vendors on the Client’s behalf and is not liable for any vendor’s inability to accommodate a new date.
14. GOVERNING LAW
a) Any contract made between Elope Easy and the Client shall in all respects be governed by and construed in accordance with the law of Scotland, and the parties submit to the jurisdiction of the Scottish courts.
b) The Client agrees to the Terms and Conditions of this contract once the booking fee has been paid.
c) There is no legal requirement for the Client to sign and return this contract once the booking fee has been paid.
d) In the case of working in a destination outside the UK, our team will adhere to the local laws of that country. Any dispute arising in connection with services provided abroad will nevertheless be resolved under UK law. Please note: where services are delivered by vendors in another country, the vendor’s own terms, conditions, and local laws will apply, and Elope Easy accepts no liability for their performance.
e) Our team will comply with applicable data protection laws, including the General Data Protection Regulation (GDPR), when handling personal data.
15. INSURANCE
The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation or other situations arising. Elope Easy may need to make a claim against the Client’s insurance should such a situation occur.
16. MEALS, REFRESHMENTS and BREAKS
a) Our team is used to long shooting days, and will endeavor to capture as much as possible, however we recommend the Client to be mindful of our team’s needs for breaks (including food and toilet breaks).
b) Our team will take a break from working whilst eating their food. Break length will be sensible and in accordance with the day’s timeline, to ensure no key moments are lost. This may include them going somewhere else to buy their own food or take some time off and recharge. Our team will always be reachable over the phone and won’t leave for long. ,
17. ON THE DAY
The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation or other situations arising. Elope Easy may need to make a claim against the Client’s insurance should such a situation occur.
a) The Contractor will arrive with plenty of time to the wedding location to meet and coordinate vendors, check final details, and make sure everything runs smoothly. The Contractor will endavour to manage any unforeseen issue promptly and switly, and keep you informed should any concern arise.
b) Elope Easy is the only authorised photographer for the day. Other professional photographers are not permitted whether official or otherwise, working for pay or otherwise (e.g. separately employed by parents, contracted by magazines or newspapers), unless agreed in writing before the day.
Breach of this condition shall be deemed cancellation of the contract by the Client. The Contractor will photograph the day from the morning prep, if you wish to include that, at a pre-agreed time, to the dinner/ final party/ activity (at a pre-agreed time).
b) Elope Easy is contracted to capture all photographs relating to the event and no other person is permitted to shoot images for sale or as gifts unless agreed in writing before the day. This includes guests (except for their own personal non-commercial use) and other wedding vendors (e.g. a videographer may not shoot stills other than a small quantity to illustrate the video package). Breach of this condition shall be deemed cancellation of the contract by the Client.
c) An inconsiderate guest or other supplier can compromise the photographic record of your day. Coverage may be cancelled without warning at the discretion of Elope Easy if our team feels threatened in any way, or has reason to believe that equipment may be damaged or stolen. Please refer also to Section 11.
18. ONLINE GALLERY
a) The online gallery will be available within approximately 28 days after the wedding date. Please note that this is an estimated timeframe and may be subject to change as outlined in Section 22.
b) The gallery will contain all high-resolution edited images that Elope Easy deems to be of an acceptable professional standard. If you have requested at the time of booking that your images not be displayed publicly on our website (see Section 4), the gallery will be password-protected and accessible only to you.
c) Only the Client and their guests will be able to download the images, and the Client retains personal printing rights as outlined in Section 3. These rights are for private, non-commercial use only.
d) Clients are advised to download all images as soon as possible. After 6 months from delivery, Elope Easy cannot guarantee that the gallery or the digital images will remain available
19. DELIVERY TIME FRAMES
Due to workload at particular times of the year the dates below are estimates only.
Online gallery of wedding photographs: 28 days
During summer wedding season, please allow 5 days extra for busy periods, although we will attempt to meet the 4 weeks maximum for delivery of your wedding photographs.
20. IMAGE MANIPULATION
a) Our team will apply a range of standard image manipulation techniques to the Client wedding photographs. This includes, but is not limited to unwanted object removal, skin smoothing, sharpening and Black & White conversions.
b) The Client shall not be charged for removing features that are not normally present. This includes but is not limited to items such as stress spots, cold sores and shaving/heat rashes. This does not include reactions to makeup or medication however.
c) Image manipulation for reasons of “digital cosmetic surgery” will be charged a rate of £125 per hour or part thereof. This includes but is not limited to tattoo removal, tan line removal, enhancements or reductions to the natural figure. It is estimated that 4 photographs can be edited per hour.
d) Wherever possible, the photographer will attempt to avoid distractions in the background whilst shooting and editing; however, the nature of weddings and wedding photography makes it hard to achieve this 100%. Where this is not possible, a flat charge of £125 per wedding gallery may be applied if you request to remove these distractions.
e) The photographer reserves the right to refuse requests for any photo manipulation where, in the opinion of the photographer, the requests are excessive.
21. USE OF DRONES BY OTHER WEDDING SUPPLIERS
Elope Easy will not be held liable or accountable for any issues and/or accidents involving the use of drone technology by other wedding suppliers or guests.
The videographers I suggest are, to my most updated knowledge, fully licensed and insured to use drone cameras and or drone video equipment.
22. SUITABLE CLOTHING & PREPPING
a) Please wear appropriate clothing for your bridal preparation photographs. Consideration should be given as to who you will get into your wedding dress to avoid damaging hair/makeup. This also applies to bridesmaids’ clothing during bridal prep. This will help your make-up artist (MUA) and hairdresser ensure their work doesn’t get damaged from tight-fitting clothing having to be taken over your head and to ensure that strap marks (from underwear) are not visible during your wedding photographs.
b) If hiking or undertaking any other activity before, during or after your ceremony, please consider wearing appropriate footwear and clothing, to be swapped with wedding attire when necessary and where safe. Our team will bring a changing pop-up tent to give you privacy, should you require to get changed in the wild.
c) Elopements involve getting married in outdoor and sometimes remote locations. Please consider temperatures and weather when deciding what to pack, and consider bringing a rucksack with the essentials if you decide to get changed on location. The Client and their guests understand and agree that participation in outdoor activities is entirely voluntary and at their own risk. Please refer to Section 11 and 12.
d) It is advised to wear loose fitting garments that easily be unbuttoned or easily removed over your head and shoulders.
e) The removal of strap marks is not included in our standard editing and retouching of your wedding photographs would incur an extra charge (as per Section 24).
f) As part of Elope Easy’s services, the photographer is happy to help fixing hair, dress and accessories during the session.
23. AMENDMENTS
Any error or omission in any information or document we issue shall be subject to correction, provided that the correction does not materially or financially affect the contract.
